No enhancement fee for alternative plots allotted by HUDA in Gurgaon

Good news for those who were given possession of alternative plots instead of the original HUDA plot allocated to them. Now, they can avoid paying the enhancement fees in their sectors if they were originally given plots in sectors where no enhancement was demanded.

The Haryana Urban Development Authority (HUDA) has been forced to set up a precedent in which a plot owner was issued enhancement notice, but later relented.

HUDA estate office (II), had issued a notice to S K Bansal, who was allotted plot No. 326 in Sector 28, but due to some dispute, HUDA could not deliver the possession. Bansal was given an alternative plot in Sector 38 and after that he was asked to pay an enhancement amount of Rs 9,27,000 for the plot originally allotted to him in Sector 28.

The plot owner had paid the amount to HUDA, but also moved the Punjab and Haryana high court challenging the HUDA’s notice.

The court said: “The petitioner will be liable to pay the enhancement cost of Sector 38, if any. Since he (petitioner) has deposited the aforesaid amount before filing this petition, HUDA is directed to refund the said amount, if there is no enhancement of acquisition costs in Sector 38.”

The court also quashed the notice issued to the petitioner and also said that if there is any enhancement of the acquisition cost in Sector 38, then same will be charged from the petitioner after providing an opportunity of hearing to him, and after deducting the said amount, the balance amount shall be refunded to him.
